Mataki Labs LLC (“Sandbar,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of the Sandbar hosting platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. Section 512, we will respond expeditiously to claims of copyright infringement committed using the Services.
1. Filing a DMCA Takedown Notice
If you believe that content hosted on the Sandbar platform infringes your copyright, you may submit a written notification to our Designated Agent. To be effective under the DMCA, your notification must include the following:

Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works on the Services are covered by a single notification, you may provide a representative list.

Identification of the infringing material: A description of the material that you claim is infringing, including the specific URL(s) or other information sufficient to permit Sandbar to locate the material on the Services.

Your contact information: Your name, mailing address, telephone number, and email address.

Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Accuracy statement: A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Signature: Your physical or electronic signature (or the signature of a person authorized to act on behalf of the copyright owner).
Important: Knowingly submitting a materially false DMCA takedown notice may subject you to liability for damages, including costs and attorneys’ fees incurred by the alleged infringer or by Sandbar (17 U.S.C. Section 512(f)).
2. Designated Agent

We will acknowledge receipt of properly submitted takedown notices within two (2) business days.
3. Response to Takedown Notices
Upon receiving a valid DMCA takedown notice, Sandbar will:
- Remove or disable access to the allegedly infringing material promptly.
- Notify the account holder whose content was removed or disabled, providing a copy of the takedown notice (with the complainant’s personal contact information redacted as appropriate).
- Document the notice in the account holder’s DMCA strike record.
4. Counter-Notification
If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our Designated Agent. Your counter-notification must include:

Identification of the removed material: A description of the material that was removed or to which access was disabled, and the URL or location where the material appeared before it was removed or disabled.

Statement under penalty of perjury: A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Sandbar may be found), and that you will accept service of process from the person who provided the original takedown notice or an agent of such person.

Your contact information: Your name, mailing address, telephone number, and email address.

Signature: Your physical or electronic signature.
5. Restoration of Content
Upon receipt of a valid counter-notification, Sandbar will:
- Forward the counter-notification to the original complainant.
- Inform the complainant that the removed material will be restored in ten (10) business days unless Sandbar receives notice that the complainant has filed a court action seeking to restrain the account holder from engaging in infringing activity related to the material.
- Restore the material (or cease disabling access to it) not less than ten (10) and not more than fourteen (14) business days after receipt of the counter-notification, unless the complainant files a court action as described above.
6. Repeat Infringer Policy
Sandbar maintains a policy for the termination of accounts of repeat infringers in appropriate circumstances.
- First strike: The account holder receives a written notification that a DMCA takedown has been processed against their account.
- Second strike: The account holder receives a second written notification and a warning that a third valid DMCA takedown will result in account termination.
- Third strike: The account is terminated, and the account holder is notified of the termination. Terminated users may not create new accounts.
Sandbar reserves the right to terminate any account at any time if, in our sole discretion, the account holder is a repeat infringer, regardless of the number of formal DMCA notices received. Sandbar also reserves the right to terminate accounts upon a single DMCA notice in cases of egregious or willful infringement.
Strikes are counted on a per-account basis and do not expire. However, a strike may be rescinded if a valid counter-notification is submitted and the complainant does not file a court action within the statutory period.
7. Misrepresentation
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees. If you are unsure whether material hosted on Sandbar infringes your copyright, you should consult an attorney before submitting a DMCA notice.
8. Modifications to This Policy
Sandbar may update this DMCA Policy from time to time. We will post the updated policy on this page and update the “Last Updated” date.
